Any access and/or use of the site www.berteil.com implies compliance with all the provisions of these general conditions and their acceptance. They therefore constitute a contract between Berteil and the user/customer.
- Customer: means any natural person who acts for purposes that do not fall within the scope of his commercial, industrial, craft or liberal activity, aged at least 18 and having ordered at least once on the site. The customer has a berteil.com customer account.
- Identifier: means the e-mail address necessary to identify a user on the site to access his account.
- Password: means the succession of characters which the user must keep secret and allowing him, with his identifier, to access his account.
- Website: www.berteil.com
- User: means any person using the www.berteil.com site or one of the services offered on it.
- Identified user: means any person using the www.berteil.com site or one of the services offered on it and having a Berteil account.
2.2 CONDITIONS OF ACCESS AND USE OF THE SITE

All information provided by the user must be accurate. The customer can enter a telephone number of their choice: office and/or mobile and/or home.
When the user creates an account on the site, he receives an account creation confirmation email the same day. Berteil.com reserves the right to delete any account that does not comply with these contractual conditions.
- TERMS OF SALES
The General Conditions of Sale define the conditions applicable to sales concluded between on the one hand the persons making a purchase via the website www.berteil.com, hereinafter referred to as "the customer" and on the other hand the company Berteil SAS, hereinafter referred to as “Berteil.com”. These conditions relate exclusively to non-trading natural persons.
3.1 PRICE OF ARTICLES AND ORDER
All prices are indicated in euros, all taxes included, excluding shipping costs.
The period of validity of the prices of the items offered on Berteil.com is 24 hours from their publication on the site www.berteil.com. Items will be invoiced on the basis of the rates in effect at the time of order entry. They remain the property of Berteil.com until full collection of the price by Berteil.com. This price is payable in full (see paragraph "Retention of title").

The ordering process is as follows:

Berteil.com retains ownership of the items until full payment of the order, that is to say the collection of the price of the order by Berteil.com.
Berteil.com reserves the right to cancel or refuse any order from a customer with whom there is a dispute relating to the payment of a previous order or who, in his view, presents any form of risk.
Any order implies acceptance of the prices and description of the items available for sale. Berteil.com undertakes to honor orders received on the website only within the limits of available stocks. In the absence of availability of one or more item(s) ordered, Berteil.com undertakes to inform the Customer as soon as possible, and if necessary to reimburse him at the latest within 14 days following the date on which he exercised his right of withdrawal. The customer's order will then be automatically cancelled.
Berteil.com reserves the right to verify the personal data communicated by the customer and to adopt all the measures deemed necessary to verify that the person who placed the order is indeed the person holding the customer account and/or the means used, in order to avoid any identity theft or any fraudulent payment.
3.2 SHIPPING AND DELIVERY
Excluding sales periods and loyalty offers reserved for customers, any order placed on the Berteil.com site before 4 p.m. Monday to Friday (excluding public holidays) will be prepared and shipped the next day, subject to validation. payment (see paragraph "Payment validation").
Berteil.com undertakes to deliver the items ordered and paid for by the customer according to the following methods and delivery times:
Delivery in metropolitan France, Principalities of Monaco and Andorra:
- Colissimo tracking: 48 to 72 hours from dispatch*, Monday to Saturday
- Pickup relay: 48h to 72h from dispatch*
The customer is required to check the condition of the items delivered.
Any anomaly concerning the articles (damage, missing article compared to the order form, damaged or open package, broken article, etc.) must be indicated within 3 days of delivery.
For any delivery to a Relais Pickup, the customer must check the contents of the package as well as the condition of the items at the Relais point before signing any delivery slip (paper or electronic). Any open, incomplete package, and/or any damaged item must not be accepted by the customer. The customer will inform Berteil.com of the problem encountered.
All items offered by Berteil.com are subject to the legal guarantee provided for by articles 1641 and following of the Civil Code (see paragraph “Warranty”).
Shipping costs are free for any delivery in mainland France (including Corsica and Monaco).
The shipping costs, for any delivery outside mainland France, will be specified to the customer during the final validation of his order.
MEANS OF PAYMENT
Payment for purchases is made by Visa, MasterCard or Carte Bleue bank card.
No cash refund will be made by Berteil.com in the event of the return of one or more items. The corresponding card will be automatically credited with the corresponding amount by the partner concerned.
The payment is validated upon receipt of the additional information requested in the event of payment by credit card requiring additional checks.
REGISTRATION OF BANK DETAILS
Berteil.com cannot, under any circumstances, save the banking information of its customers.

FIGHT AGAINST BANK CARD FRAUD
The information related to your order is subject to automated data processing, the manager of which is Berteil.com. The purpose of this automated data processing is to define a level of analysis of a transaction and to fight against credit card fraud.
Berteil.com is the recipient of the data relating to your order. The non-transmission of data related to your order prevents the realization and analysis of your transaction.

The absence of a response from the customer to a request of this type within 2 days of the request made by Berteil.com will automatically lead to the cancellation of the order concerned, without any possibility of subsequent complaint.
Berteil.com will also be completely free to proceed with the direct cancellation of an order that presents one or more risk factors for fraudulent use of a bank card.
3.4 RETURNS AND REFUNDS
RIGHT TO RETRACT
You have the right to withdraw from this contract without giving any reason within fourteen days of receipt of the product. To exercise the right of withdrawal, you must notify us of your decision to withdraw from this contract by means of an unambiguous statement (eg letter sent by post or e-mail). You can use the model withdrawal form but it is not mandatory. For the withdrawal period to be respected, it is sufficient that you send your communication relating to the exercise of the right of withdrawal before the expiry of the withdrawal period.
Effects of withdrawal

Return conditions for reimbursement
The returned item(s) must be new, unused and in their original box, perfectly intact.
Any return must be the subject of a return request from the “My personal information” section of the www.berteil.com site.
The customer may make a single online return request per order on the www.berteil.com website.
If the customer's order includes several articles and he wishes to return more than one article, he must select during this return request all the articles he wishes to be reimbursed.
The customer must return the unwanted items at his own expense within the period provided for this purpose.
If the customer wishes to return items from different orders, he must separate said items in different packages when returning. Any return of items from different orders that do not comply with this condition cannot be processed according to the deadlines set out in our GCS.
All returned items (shirts, original packaging, accessories, instructions, etc.) must be returned perfectly intact.
Upon receipt of the package, Berteil.com will judge the perfect condition of the returned goods. No returns will be accepted if the returned items have been visibly used or damaged by the customer and such use or damage renders the items unfit for sale.
In the event of your withdrawal from this contract, we will refund all payments received from you (with the exception of additional costs arising from the fact that you have chosen, where applicable, a method of delivery other than the less expensive method standard delivery offered by us) without undue delay and, in any event, no later than fourteen days from the day on which we are informed of your decision to withdraw from this contract. We may withhold reimbursement until we have received the goods. We will make the refund using the same means of payment as you used for the initial transaction, unless you expressly agree to a different means; in any case, this refund will not incur any costs for you. In the event of receipt of a return package whose content does not comply with the return request or whose items do not comply with the return conditions mentioned above, Berteil.com reserves the right to exercise any corresponding recovery from the Client.
For health and safety reasons, the customer cannot exercise his right of withdrawal for the following items:
- socks ;
- underwear, especially boxers, underpants…
Berteil.com reserves the right to modify this list.
RETURN OF THE GOOD PRODUCT
The customer must imperatively return to us the product purchased on the site www.berteil.com, new and unworn, for which he has exercised his right of withdrawal. If the customer does not return the correct product, Berteil will send him an email inviting him to recover it at his expense, within two months from the date of the email. After this period, Berteil will consider itself the owner within the meaning of article 2276, paragraph 1 of the Civil Code which provides: “In terms of furniture, possession is equivalent to title. » and will reserve the right to destroy the property. Berteil cannot be held responsible for the fact of this destruction.

All items offered by Berteil.com are subject to the legal guarantee provided for by articles L 217-4 and following of the Consumer Code and the guarantee against hidden defects provided for by articles 1641 and following of the Civil Code.
The customer has two years to assert one or the other of these guarantees. For the lack of conformity, the period runs from the delivery. For hidden defects, the period runs from the discovery of the defect.
If the apparent defect, the lack of conformity or even the hidden defect of the article, declared by the customer, if applicable, is proven, after expertise has been carried out, Berteil.com may repair or replace the Product. If this is not possible, Berteil.com will reserve the right to reimburse the customer at his own expense.
Berteil.com cannot be held responsible for the misuse and/or intensive use of the items that the customer may make of them. Berteil.com does not offer a commercial guarantee.
Article L 217-4
The seller delivers a good in conformity with the contract and is liable for any lack of conformity existing at the time of delivery.

3.8 RETENTION OF OWNERSHIP
Berteil.com remains the owner of the goods until full payment of the price by the customer.
